Terms & Conditions of Sales

  1. Purpose

These general terms and conditions apply to all online bookings made with our establishment ATELIER 69 using the Regional Marketing Tool (RMT).

The customer acknowledges having read and accepted these general terms and conditions. No booking is possible without the customer's agreement to them. The customer has the option to save and print these general terms and conditions.

  1. Offers

All our advertisements, web pages, and offers are prepared in good faith and based on available data. Maps, photos, and illustrations are for informational purposes only and are not contractually binding.

These details may be subject to change before the booking is finalized. The client authorizes us to correct any obvious material errors in the information we provide.

  1. Price

The prices displayed at the time of booking constitute the total price of the service sold, including taxes, fees, and other charges. Any additional charges are clearly indicated before the service is booked.

  1. Booking

The client selects the services presented on the regional marketing platform. The customer acknowledges having reviewed the nature, destination, and booking procedures for the services available on the booking tool and having requested and obtained all necessary and/or additional information to make an informed booking. The customer is solely responsible for their choice of services and their suitability for their needs; therefore, we cannot be held liable in this regard. The booking is deemed accepted by the customer upon completion of the booking process. Booking Process: Reservations made by the customer are processed via the online booking form accessible through the booking tool. The booking is considered confirmed upon receipt of the booking form. Prior to making any booking, the customer agrees to provide all necessary information. The customer attests to the truthfulness and accuracy of the information provided. Once the final selection of services to be booked has been made, the booking procedure includes the following steps up to validation:

entering credit card details if a guarantee or prepayment is required, reviewing and accepting the general terms and conditions of sale relating to the service(s), and finally, validation of the booking by the customer.

  1. Booking Acknowledgement

The booking tool acknowledges receipt of the customer's booking and confirms it by sending an email without delay.

The booking confirmation email summarizes the contract offer, the services booked, the prices, the terms and conditions of sale applicable to the selected rate and accepted by the customer, the booking date, and the address of the establishment to which the customer can submit any complaints. Right of withdrawal: It is reminded that, in accordance with Article VI.53 of the Belgian Code of Economic Law, if the contract stipulates a specific date or period of performance, the customer does not have the right to withdraw from the booking of: accommodation other than for residential purposes (e.g., holiday accommodation), a Transportation, car rental, catering, and services related to leisure activities. Payment: The customer provides their bank details as a guarantee of the reservation, except in the case of special conditions or rates, by credit or debit card (Visa, Mastercard, American Express, Diners Club, etc., depending on the options offered by the establishment's booking platform). The card number, without spaces between the digits, its expiry date (it is specified that the bank card used must be valid at the time of service), and the security code must be entered directly in the designated area (secure entry via SSL encryption). The customer must present the bank card used to guarantee the reservation at the establishment. Payment is debited at the time of booking. This prepayment is considered a deposit. In the event of a no-show (reservation not cancelled – customer not present) for a reservation guaranteed by credit card, the establishment will debit the customer, as a fixed compensation, the amount indicated in its general terms and conditions and specific terms of sale. The establishment has chosen elloha.com/stripe.com to secure online credit card payments. The validity of the customer's payment card is verified by stripe.com. A payment card may be declined for several reasons: stolen card, blocked card, spending limit reached, incorrect entry, etc. In case of a problem, the customer should contact their bank and the establishment to confirm their reservation and payment method. For rates requiring online prepayment, the advance payment, which constitutes the deposit, is debited at the time of booking. Some establishments may generate invoices/receipts electronically; the original file is certified and available online at the web address provided by the establishment. A €400 credit card authorization will be required at the time of booking as a security deposit. It may be retained in whole or in part in the event of damage, deterioration, loss, theft, non-compliance with the rules, or additional charges discovered after departure.

After verification of the accommodation and equipment, the credit card authorization will be released if no damage is found.

  1. Privacy Policy

We collect your data in accordance with the General Data Protection Regulation (2016/679) (“GDPR”).

The personal data you provide is necessary for processing your booking and is essential for the management and provision of services (Article 6.1.b of the aforementioned Regulation). For these purposes, your data may be transferred to our partners, including Elloha.com, which manages the booking tool, online payment providers, and providers established in third countries. Specifically, during online payment, the customer's bank details must be transmitted by the payment provider to the establishment's bank for the execution of the booking contract. We only use partners who guarantee a level of protection compliant with the principles of the GDPR. With your consent, your data may also be used by us to send you our promotional or commercial offers by email or post. We retain your data for a period of 3 years after the last contact (email, booking, etc.). As a data subject, you have the right to access, rectify, and erase your data, as well as the right to object to the collection of your data. These rights can be exercised by sending us an email, mentioning your first and last name and address, as well as the subject of your correspondence. Your complaints relating to the collection and processing of your personal data can be addressed to the competent supervisory authority.
